ENGIE Gas and Exelon Responds to Protest of Petition for Capacity Release Waiver

The arguments raised in the protest by the Eastern New England Consumer-Owned Systems (ENECOS)10 of ENGIE Gas & LNG LLC’s and Exelon Generation Co. LLC’s (RP18-806) joint petition for a temporary waiver from capacity release regulations and tariff provisions are outside the scope of the petition ENGIE and Exelon told the Commission in a June 1 response to the protest. In the protest, ENECOS claimed ENGIE and Exelon failed to explain that the petition is part of a larger transaction about Exelon’s acquisition of the Everett Marine Terminal LNG facility, but ENGIE and Exelon argued in their response that the transaction has nothing to do with their petition, and the protest should be dismissed.
