FERC Approves Overall Settlement of Deferred Transportation Cost Tracker Issues, Among Others, Triggered By Contract Changes Between ANR Pipeline and Great Lakes Gas Transmission; Severs a Large Contesting Shipper, DTE Gas

FERC last week addressed a settlement report, including a contested settlement agreement, submitted in July by Presiding Administrative Law Judge David Coffman with regard to contractual issues involving ANR Pipeline Co. and Great Lakes GAs Transmission LP (RP15- 138 et al.), and involving indirectly TransCanada Pipelines, set for hearing for the Supporting/Non-Contesting parties. The ANR and Great Lakes proceedings in Docket Nos. RP14-650 and RP15-785 were not before the settlement judge but those issues are also resolved by the settlement. Such issues include (1) the level of costs eligible for recovery under ANR’s DTCA mechanism for the period commencing in May 2013 through the settlement termination, and (2) the abandonment of so-called T-Agreements (explained below), subject to certain reservations relating to cost issues that may arise after the settlement expires. The Commission will sever the remaining party, DTE Gas Co. (DTE), and the severed proceeding shall be remanded to the Chief ALJ to commence procedures for hearing.
