The U.S. Environmental Protection Agency (EPA) on August 9, issued a proposed rule to increase the transparency and efficiency of the Clean Water Act (CWA) Section 401 certification process. According to EPA, the existing Section 401 certification rules haven’t been updated in 50 years, and are “inconsistent with the text of CWA Section 401, leading to confusion and unnecessary delays for infrastructure projects.” EPA said issuance of the rule starts a 60-day comment period.
