The National Labor Relations Board (NLRB) issued three significant decisions at the end of August that promote union organizing and protect new or established union representations. According to ILMA Counsel Jeff Leiter, the three cases, combined with the NLRB's recent rule requiring all employers covered by the National Labor Relations Act (Act) to post a notice in their workplace informing employees of their rights under the Act, have two practical effects for employers, including ILMA members. First, the decisions facilitate new union organizing in small bargaining units that will provide the union with a platform for a broader organizing campaign. Second, new or established union representations will be shielded from challenge by the employer, employees or rival unions.
