Ofwat serves notice of financial penalties on Southern Water for breaches of licence conditions and statutory duties

The April 2019 edition of Environmental Law Monthly discussed the case of Millmore and others v Environment Agency [2019] EWHC 443.The Environment Agency had prosecuted employees of Southern Water(SW)for obstructing the Environment Agency officers in their investigations at various sewage treatment works.SW had been acquitted at an earlier stage of proceedings as the prosecution had failed to prove the company was criminally liable for the actions of its employees.In June this year,Ofwat served a notice under s 22 A of the Water Industry Act 1991 for the intention to impose a financial penalty of ￡37.7 million(reduced to ￡3 million)on S W for breaches of its licence conditions and statutory duties.It has invited comments from the public.
