401 (k) Court Decision Stirs Concern

A recent federal district court decision in Missouri, holding a 401 (k) plan sponsor, employee fiduciaries and record keeper liable for more than $35 million in damages under ERISA for failing to control costs, permitting the plans to pay excessive revenue-sharing compensation to service providers and imprudently selecting investment options, is raising concerns with employers and others involved with employee retirement plans.
