A New EC Noise Directive-Incorrect or Correct Trends for Noise Control at the Workplace

In 2001 a new European Noise Directive for the protection of employees was drawn up which will supersede the currently valid Noise Directive (86/188). At present it is passing through the European legislative process. In this article the noise situation is analysed and compared with the planned provisions of the new Noise Directive, based on the Noise Directive currently valid. Although the new Noise Directive provides for a number of major changes, the basic problems of corporate noise control are not adequately dealt with. Under the new Directive certain noise reduction measures do not have to be taken from 85 and 90 dB, but already from 80 and 85 dB; this extends the employees' protection. Furthermore an exposure limit value is introduced which includes hearing protectors. It is adhered to at practically all relevant work places in the EC member states provided suitable hearing protectors are supplied. The result could be that the noise situation stays as it is: 10-15% of employees will continue to be exposed to noise which is a serious health hazard. In this way employee protection is based less on technical measures to reduce noise emissions and exposure, but more on checking the behaviour of employees. An analysis of the situation and the Directive shows that it does not promote the motivation of the users and manufacturers of machines to find ways of implementing the mandatory minimization of the risk from noise as laid down in the Machinery Directive and Noise Directive; moreover there is a lack of requirements regarding the noise control programme to improve both the selection and operation of 'quiet' machines and working procedures and the wearing of hearing protectors. Some of the figures and examples were taken from the situation in Germany. Proposals for improving and implementing the new Noise Directive are put forward.
