India claims U.S. did not follow WTO rules, cannot retaliate in solar fight

India has charged that the World Trade Organization's Dispute Settlement Body cannot authorize the United States to suspend trade concessions in a dispute over India's national solar program because India has complied with the rulings and recommendations in the case and the U.S. did not follow WTO rules in requesting the right to retaliate. The United States on Dec. 19 said India had not complied in the case, and on Jan. 12 it is scheduled to seek authorization from the Dispute Settlement Body to suspend concessions at a level equal to the impact of India's failure to comply under Article 22.2 of the Dispute Settlement Understanding. India on Dec. 14 said it had complied in the case, and last week - in a Jan. 3 communication publicly released on Jan. 8 - the country reiterated that stance and introduced new arguments for why it believes the DSB should not grant U.S. authorization to retaliate.
