The Sierra Club and Environment Texas issued a second warning to Exxon Mobil that it faces a citizen lawsuit seeking enforcement of the US Clean Air Act against the nation’s largest refinery, according to a statement issued by the groups. Under the federal Clean Air Act, a 60-day notice of intent to sue must be filed with the alleged polluter along with federal and state pollution regulators before a citizen lawsuit may be filed in federal court. A similar warning in November failed to draw Exxon into an agreement to cut pollution from the company’s 572,500 b/d Baytown, Texas, refinery.
