New York-The California Air Resources Board has shifted to a new court in an attempt to win a stay of a decision halting enforcement of its Low Carbon Fuel Standard, after being denied its motion by a judge January 23, a CARB spokesman said January 24. "ARB will now take its request for a stay of the injunction to the 9th Circuit and believe we will prevail there," said CARB spokesman Dave Clegern in an emailed statement. "ARB has already filed its appeal of the full deci- sion with the 9th Circuit. The timetable on the motion to stay the injunction in the appellate court, and on the appeal itself, are still being developed by the court."
