The electronic structure of the out-of-plane impurity-controlled cuprate superconductors is studied based on the kinetic energy driven superconductivity. It is shown that the effect of the out-of-plane impurity scattering is stronger in the antinodal region than that in the nodal region, this leads to a strong deviation from the monotonic d-wave gap form in the out-of-plane impurity-controlled cuprate superconductors.
