The debate about who bears responsibility for making crude - by - rail shipments safer has spilled into the US courts, with a refining industry group suing rail operator BNSF for imposing a surcharge on customers who use older tank cars to transport oil. The American Fuel and Petrochemical Manufacturers (AFPM) has filed a complaint with the US district court in Houston, arguing that the $1,000 premium that BNSF charges to move the older DOT - 111 tank cars is intended to make those customers convert to newer cars.
