Dow presses US court to reject EPA Enlist Duo move

Dow AgroSciences has asked the US Court of Appeals for the 9th Circuit to deny the US EPA’s bid to vacate the registration of its herbicide, Enlist Duo (2,4-D choline + glyphosate), arguing that there is “no basis in law or logic” for the Court to grant the Agency’s request. The company says that the Court should instead remand the issue back to the EPA to review new information about the possible synergistic effects of the pesticide on endangered plant species. In the interim, Dow says that it would agree to stop sales of Enlist Duo and “to work out an appropriate agreement” with the Agency.
