A federal judge has dismissed part of a lawsuit filed by EPA against W.R.Grace,which alleges that the company knowingly endangered the health of residents and workers in Libby,MT by not disclosing information about the health risks posed by the company's vermiculite mine.The judge threw out part of the conspiracy charge,but the company still faces charges of violating environmental laws and obstruction of justice.The judge ruled that EPA's attorneys have not established an"overt act"of conspiracy that fits within the five-year statute of limitations.The judge did not throw out the entire conspiracy charge,although sources say that EPA's position in that portion of the lawsuit has been significantly weakened."The knowing endangerment allegation of the conspiracy charge will be dismissed,"according to the judge's order.
