Appraisal of litigation against English Health Trusts in the treatment of adults with ear, nose & throat pathology: how we do it.

Dear Editor, The NHS Litigation Authority was established on the 20th November 1995 to indemnify English National Health Service (NHS) bodies against claims for clinical negligence. As such, it is a Special Health Authority and part of the United Kingdom NHS. Initially, its sole function was to administer the 'Clinical Negligence Scheme for Trusts', a risk-pooling scheme in respect of clinical claims arising from incidents on or after 1st April 2000. Figure 1 demonstrates number of new claims filed. The rise observed in the mid 1990s is in part because of the foundation of the NHS Litigation Authority Clinical Negligence Scheme for Trusts, taking over cases previously managed at Trust level. The figure appears to illustrate a lower number in recent years, however, to qualify this. Trusts are not usually informed of pending litigation until a number of years have passed.
