The US Court of Appeals for the 5th Circuit, in handing down its decision Monday, denied petitions from both environmental petitioners who wanted penalties for excess emissions during these unplanned activities and from industry petitioners who argued for relief from penalties from excess emissions stemming from planned startups, shutdowns, and maintenance (SSM).
