CFTC toughens market fraud, manipulation rules

The Commodity Futures Trading Commission approved two final rules Thursday that will dramatically broaden the agency's power to police manipulation and fraud in futures and swaps markets. Under the rules, which passed unanimously, the CFTC will no longer have to prove that a potential defendant acted intentionally, nor will it have to prove that the defendant caused an artificial price, when prosecuting for fraud and manipulation. The lower standard is expected to increase the number of fraud and manipulation cases that the CFTC can now pursue.
