On 13 October 2004, the Federal Court (in Concrete Parramatta Design & Development Pty Ltd [2004] FCA 1312) found an architect was guilty of unjustifiable threats of copyright infringement proceedings, against a third party purchaser of land. The Court found that the architect's grievance was with the former owners of the land, not the purchaser, and he should not have written threatening letters to the purchaser. This case provides a reminder to architects and other copyright owners to exercise care when sending threatening letters before commencing proceedings.
