The appeals court ruled that the Inland Wetlands Commission of Seymour,Conn.,improperly rejected landowners' application for a wetland permit allowing them to build a subdivision on their property,because there was no substantial evidence in the record supporting its decision.John and Anna Fanotto own a 20-acre parcel of residential-zoned land in Seymour on which they proposed to build 20 houses.There are 5.1 acres of wetlands on the property,3.6 acres of which are in 4.1 acres of land proposed for dedication as open space.
