John Smith was spraying paths with a herbicide. On returning to his van to refill his knapsack from a measuring jug, he oecame breathless, dizzy and lightheaded. Soon afterwards, a member of the public found him unconscious and he was taken to hospital, where he was kept under observation for 24 hours. An investigation found that he was inexperienced and had only worked for the council for four days. His supervisor, who held a relevant certificate of competence, had left Smith and gone to work on another site. The van had no ventilation and the wooden floor had become moist and contaminated.
