The US DC Circuit Court of Appeals has dismissed a joint lawsuit from Utility Air Regulatory Group (UARG), Power4Georgians, Tri-State Generation, Las Br is as Energy Center, Sunflower Electric Cooperative, and White Stallion Energy Center, first filed on June 12, which had challenged the legality of the EPA's latest New Source Performance Standards (NSPS) for power plants. The NSPS mandates that any unit beginning construction and obtaining related permits later than April 13, 2012, will be considered a "new unit" and subject to all associated regulations, while units having applied for a Prevention of Significant Deterioration permit prior to mat date and beginning construction within a year would be exempt.
