Alabama Power targeted as DOJ ranges to address NSR issues

The federal Department of Justice, on behalf of the U.S. Environmental Protection Agency, has taken what it called "another significant action" against a utility plant for alleged Clean Air Act violations. The DOJ filed a motion in the U.S. District Court for the Northern District of Alabama to restart litigation against Alabama Power, which was stayed earlier at Alabama Power's request, based on TVA's appeal of a case that involved similar issues concerning the interpretation of the CAA as it is applied to utility plants. The stay remained in effect until February 13, the day the government asked the Supreme Court to review the TVA case.
