CN seeks relief after Canadian arbiter rules for coal producer

Apparently convinced of the unfairness of the final offer arbitration process that set new rates for the movement of export coal from the Dillon mine to Ridley Terminals at Prince Rupert, BC, Canadian National Railway has asked the courts to intervene. CN applied for a judicial review of an arbitrator's selection of Western Canadian Coal's final offer, which was chosen early in September. WCCC requested the FOA process early in July. Shippers alone are allowed to seek such relief. CN appears to be challenging not so much the merits of this decision but the fairness of the whole FOA process. The courts have not decided when the case will be heard.
