US biocides rules undergo revision

The division of authority between federal and state authorities in the US is different from the European framework, which generally provides for EU-level evaluation of active substances and member statelevel authorisation of biocidal products (although EU-level authorisation will now be available for some products under the new biocides Regulation). In the US, by contrast, all pesticides – including biocides, which are referred to as antimicrobial pesticides in the US – are regulated under the Federal Insecticide, Fungicide, and Rodenticide Act (Fifra), which requires the Environmental Protection Agency (EPA) not only to evaluate active substances, but also to register formulated pesticides for distribution and sale. In addition, many states require registration before a pesticide may be distributed or sold within their borders. Although Fifra prohibits states from imposing additional packaging or labelling requirements, states can impose additional data requirements as a prerequisite to registration.
