ERAC Update: Developments, Developments, Developments

When it rains, it pours. Regulatory developments have come in a downpour over the last few months, and it looks as if more will come. There is a new US EPA definition of waste, as the agency tries once again to conform its rules to twenty years of court rulings that materials that are not discarded are not waste. In general, the old rules continue, including the special status of precious metal refining of "hazardous waste." There are minimal additions, and in most cases, the existing definitions and rules are a better option for our industry. But the ERAC is looking carefully at the new rule, and will see if it can better fit some of our industry circumstances.
