The Directive does not apply tocertain types of EEE including large-scalestationary industrial tools, large-scale fxedinstallations. Photovoltaic panels are alsoexcluded, even though some containcadmium. (8 CW Briefng, March 2010 )EEE that was outside the scope of theoriginal Directive, but which would notcomply with this Directive, cannot beplaced on the market after 22 July 2019;the Directive applies without prejudiceto EU legislation on chemicals, “inparticular” REACH;member states must ensure EEE placedon the market, including cables and spareparts for its repair, its reuse, updating ofits functionalities or upgrading of itscapacity, does not contain the substanceslisted in Annex II (cadmium, lead,mercury, chromium VI, PBBs or PBDEs).
