SPOKANE,Wash.-The U.S.Court of Appeals for' the Ninth Circuit agreed Oct.29 to re-hear appeals on pretrial witness issues in the W.R.Grace & Co.criminal case,with the full 15-member court presiding(United States v.W.R".Grace & Co.,9th Cir.,No.06-30192,order issued 10/29/07).According to the order,the previous opinion issued July 12 by a three-member Ninth Circuit panel regarding the case now cannot be cited as precedent within the Ninth Circuit,except as adopted by the full-panel opinion.
