The Federal Mine Safety and Health Review Commission (FMSHRC) will decide whether a miner's 22-ft. fall after he came into contact with 7,200 volts of electricity was an "accident" under Part 50 regulations.FMSHRC, on its own motion March 15, directed review of a ruling by ALJ Avram Weisberger who found that the miner's injuries, which included third-degree burns, lacerations and a broken neck did not have "a reasonable potential to cause death."
