A California sand and gravel operation has agreed to pay MSHA a civil penalty reduced from 100,000 dollars to 60,000 dollars to settle a case in which a foreman was fatally injured while changing liner plates in a jaw crusher. Administrative Law Judge Gary Melick approved the settlement agreement between CalMat Co. and MSHA. The fatal accident occurred in June 2003 at CalMat's San Emidio Plant in Kern County, Calif., when the victim, 25-year-old maintenance repair foreman, Jason P. Salyards, was working inside the jaw crusher installing new liner plates. The upper liner plate had been lowered into the crusher and set in place. A section of 1 1/2-inch-wide angle iron had been wedged between the liner plate and the crusher wall to secure the liner. Salyards was attempting to align the wedge bar to fasten the liner plate, when the angle iron support dislodged and the 3,100-lb. liner plate toppled over, crushing Salyards. He had five years and 12 weeks of mining experience, all at the San Emidio Plant.
