Supreme Court Rules For Patentee on Indirect Infringement

The Korean Supreme Court has rendered a decision in favor of the patentee based on the theory of indirect infringement in a scope confirmation action. In doing so, the Highest Court rejected the accused infringer's arguments that its accused product is not an article which is employed in producing the patented product within the meaning of the statute and that, even if it were, it has other uses than that of producing the patented product.
