Engineers Ireland launch new Mediation and Arbitration Procedures

The Procedures have generally developed out of construction, principally civil engineering work, but they are intended to have a much wider application and in fact can be used in all areas of commercial activity. The more recent Procedures have been written in a modern idiom using plain English and avoiding the use of personal and possessive pronouns to make them gender neutral. Mediation Procedure 2011 Mediation Procedure 2011 provides a framework within which parties can refer disputes to facilitative mediation without imposing unnecessary constraints on them or the Mediator. The document deals with the referral of disputes to mediation, the appointment of the mediator and the conduct of the mediation. The Procedure also deals with the independence of the mediator and the confidential/ without prejudice nature of the process.
