APPEALS JUDGES MAY COME DOWN HARDER ON FCC OVER ISP TRAFFIC

The U.S. Court of Appeals for the District of Columbia Circuit may punish the FCC further unless it provides a response on the ISP remand beyond its interim order released last month, commission and industry officials said. The FCC抯 order provided additional justification for the commission抯 2001 rule on ISP-bound traffic. Chairman Kevin Martin said when the new order was issued that he considered it an inadequate response and if the appeals court wanted a more satisfactory response it should "enforce our promise of reform on pain of?throwing out the rule if the FCC didn抰 act by Dec. 18, as promised by other commissioners. nnOther commissioners contend that steps Martin has taken steps have made a response by then impossible. And with the current emphasis on the DTV transition, FCC officials say, an intercarrier compensation overhaul probably must wait until at least spring.
