An appeals filing by Qwest accuses the FCC of having “moved the goalposts back 20 yards” nwhen it rejected a forbearance petition seeking permission for the carrier to set its own rates nand terms of service in Phoenix without permission from the commission. Qwest has n“hemorrhaged market share to its rivals” and “easily meets” the standard for forbearance, the ncompany said in brief to the 10th U.S. Circuit Court of Appeals in Denver. It said the ncommission ignored longstanding tradition and continues to treat Qwest as if it were a nmonopoly.
