USEPA Proposes to Retain Current GHG Thresholds in Step 3 of the Tailoring Rule

On March 8, the U.S. Environmental Protection Agency (EPA) published the third step of its greenhouse gas (GHG) permit Tailoring Rule. Proposed Step 3 retains the current GHG permitting thresholds for the Prevention of Significant Deterioration (PSD) and Title V Operating Permit Programs under the Clean Air Act (CAA). In so doing, EPA recognizes that state agencies are not ready to handle a bigger permitting program.
