States, others eye CPP stay from Supreme Court

States, utilities and business groups have put a landmark carbon rule impacting the existing generation fleet on the fast track to the Supreme Court, ahead of a lower court ruling on the merits of the regulation. Attorneys General for West Virginia and Texas led a 26-state coalition in petitioning the high court on Tuesday to immediately stay implementation of the Clean Power Plan following the DC Circuit Court of Appeals' decision last week to deny such requests made by states and industry groups.
