Concerning Review of Damage Compensation System, etc. (1998 Amendment Act)

The 1998 Amendment Act has been enforced with the aim of facilitating full execu- tion of intellectual properties, thereby enhancing incentives for R & D activities. The amendments have been made in this act to the following effects: (1) Provisions for facilitating the establishment of lost profits will be introduced. (2) Measures will be introduced to enable parties to reflect their specific circumstances in the amount of license fee that represents the minimum compensation. (3) The upper limit of amercement to be imposed on corporations for infringement of property or other right will be raised. (4) Offenses of infringing property or other rights will be re--categorized as those sub- ject to prosecution only on complaint.
