Meyers, urges states to move quickly to reinstate the trading programs by May 1, 2009, without making any revisions to minimize the risk of lawsuits that could delay the process. Several states had planned to discontinue their NO_x trading programs in 2009 when CAIR's emissions market would take precedence. "The best way to ensure that the NBP can be in place by May 1, 2009, is for the states to propose to reinstate the same NBP rules that were previously approved at both the state and federal levels," Meyers wrote.
