Freiheit, Sicherheit und Terror: Die Rechtslage in Deutschland

The collision of security interests with individual liberties has caused legal problems in Germany since about 30 years. The article gives an overview of German anti-terrorist laws up to now, discusses how security interests were balanced against civil liberties and analyzes whether this balancing has changed in the aftermath of September 11. The article demonstrates how legal safeguards against encroachments of civil liberties in pursuing security have continuously faded. Because of this development today the German legal system provides only limited constitutional safeguards against further limitations of civil liberties in the name of an increased security.
