The issue on this appeal was whether the statutory power conferred by s.96A of the Town and Country Planning Act 1990 ("the 1990 Act") to make non-material changes to a planning permission included power to make non-material changes to conditional approvals of reserved matters. An order refusing permission to apply for judicial review held that it did. Fulford Parish Council ("PC") appealed against that order.
