St Modwen Developments Ltd, ("St Modwen") appealed against an order of Ouseley J, dated 28 April 2016, dismissing its application under s.288 of the Town and Country Planning Act 1990 ("the TCPA 1990") challenging the Secretary of State for Communities and Local Government's decision ("Secretary of State") to dismiss two appeals under s.78 of the TCPA 1990 against the refusal of planning permission by East Riding of Yorkshire Council ("the Council"), for a large development of new housing on land at Brickyard Lane, Melton Park near Hull. The third respondent, Save Our Ferriby Action Group, was an objector to St Modwen's development proposals.
