The Commission's E-Commerce Sector Inquiry: Analysis of Legal Issues and Suggested Practical Approach

The above discussion highlights two main themes for the Commission's investigation: first, existing case law and rules may not appear as the appropriate framework for analysing competition issues arising out of on-line sales and distribution. Second, the approach taken by NCAs to these issues is somewhat divergent, with the result that cross-border trading conditions have actually become more complex. It is hoped that the Commission's inquiry (and potential future enforcement) will clarify these issues in a way that encourages cross-border trade in Europe.
