FERC stays out of wires ownership dispute between Consumers, ITC subsidiary

A long-standing controversy over ownership of certain transmission assets in Michigan will have to be decided by the courts as FERC on October 4 opted to deny a petition from Consumers Energy asking it to affirm the utility’s rights to the assets. The utility has been defending its claim to 214 miles of transmission lines worth $42.6 million against assertions by Michigan Electric Transmission that it is the rightful owner under a FERCjurisdictional agreement signed in 2002.
