Spire STL Pipeline on July 26 asked the Federal Energy Regulatory Commission to grant temporary authorization to prevent an emergency shutdown in the wake of a federal appeals court decision that would vacate the certificate for the operating pipeline once it takes effect. Such action by the commission would ensure that Spire’s customers can continue receiving service through the upcoming winter, the company told FERC, seeking action by Aug. 12 to avoid “potentially lethal harm.” The future of the 65-mile, 400,000 Dt/d pipeline was thrown into question by a June 22 decision by a panel of the US Court of Appeals for the District of Columbia Circuit to vacate the FERC certificate. The court found that the regulator failed to seriously engage arguments challenging the weight of an affiliate precedent agreement in establishing the need for the project.
