The statutory exemption for industrialized housing in the Pennsylvania Construction Code Act (CCA) does not apply to site preparation, foundation construction, and connection to utilities for a manufactured home, ruled the Pennsylvania Commonwealth Court. (Modular Building Systems Association v. Department of Labor and Industry, No. 306 M.D. 2004, 2004 WL 2158134 (Pa. Cmwlth.), September 28, 2004) Modular Building Systems Associations (MBSA), a nonprofit trade association that represents Pennsylvania manufacturers, builders, and suppliers in the manufactured housing industry, sought a declaratory judgment that certain provisions of the Uniform Construction Code, which is enforced by the Department of Labor and Industry, are not applicable to manufactured homes. The CCA, enacted in 1999 to establish uniform and modern construction standards throughout Pennsylvania, applies to the "construction, alteration, repair, and occupancy of all buildings in the Commonwealth." The act specifically exempts manufactured housing that conforms to federal construction and safety standards.
