On 16 June, the Department for Transport (DfT) published a consultation titled 'Streamlining the application process on stopping up and diversion orders' as part of implementing the 2010 Penfold Review, which examined ways to minimize the burden of complying with development consents. This month, legal experts from infrastructure law firm Pinsent Masons LLP discuss the questions put forward by DfT in their consultation and the potential impacts on the existing framework. A stopping up order is the stopping up (removal of public rights of way) or diversion of a highway where it is no longer needed or a change is required to enable development to proceed.
