Health and Safety on the highways

One of the issues I find interesting is why two duty holders, who breach the same health and safety duties to the same degree, can face hugely different enforcement action and penalties depending upon the outcome of their breaches, rather than their conduct. This brings to light a significant question: Does the enforcement regime strike the right balance between tackling breach and outcome? At first sight, an outcome based approach seems unfair.
