Pothole in the road, dent in your pocket

Potholes unquestionably provoke strong emotions from road users. Part in retaliation and part in an attempt to highlight the chronic problem, the public have taken the following actions - pothole gardening; filling potholes with rubber ducks; pothole birthday parties; pothole selfies; celebrating the National Pothole Day (16 January - for those of you who were wondering); and most unsurprisingly of alt, even reporting potholes to the relevant highway authorities. However, the recent pothole-related case of CravAeyv Barnsley MBC[2017]EWCA Civ36 could ndicate that the public may have to find new non-pothole related hobbies if relevant highway authorities could be held liable for personal injury claims sustained from potholes due to reporting system failures.
