DuPont Agrees to Largest Civil Penalty Ever for Alleged RCRA and TSCA Violations

Under the terms of a consent agreement, E.I. du Pont de Nemours and Company (DuPont) will pay a $10.25 million civil penalty to settle allegations that it withheld information about the dangers associated with perfluorooctanoic acid (PFOA). The fine is the largest civil penalty ever obtained by EPA for violations of any federal environmental statute. In addition, DuPont must spend $6.25 million on two supplemental environmental projects (SEPs). EPA alleged that DuPont violated RCRA and the Toxic Substances Control Act (TSCA) by failing to provide the agency with toxicological information on PFOA, a chemical used at the company's plant in Parkersburg, West Virginia.
