The Supreme Court today declined to review a challenge from more than 100 coal companies to an Interior Department fee on mined coal for export. Aracoma Coal Company v. United States represented the latest in a long line of litigation from the coal industry seeking to undo fees on mined coal that industry claimed violated the Constitution's Export Clause, which says "no tax or duty shall be laid" on exported goods. The companies have lost several lawsuits on the fee, and today's Supreme Court action leaves a federal appellate court ruling upholding the fee. At issue are Interior regulations promulgated under the Surface Mining Control and Reclamation Act of 1977. The rules, issued the same year, require coal companies to pay Interior a fee based on tonnage for cleaning up abandoned mines.
