Environmentalists opened up a new front in the legal wrangling over the future of a controversial power plant on the Navajo reservation.rnIn a petition filed in the 9th U.S. Circuit Court of Appeals, green groups allege EPA has failed to update a water pollution permit for the Four Comers Generating Station.rnEPA last issued a National Pollutant Discharge Elimination System (NPDES) permit for Four Comers in 2001. It expired more than 12 years ago.rn"EPA is in violation of the [Clean Water Act] and its own implementing regulations," the petition for writ of mandamus in the 9th Circuit says.
